SoundONE Disco - Booking Terms and Conditions:


Herein sets forth the terms and conditions, whereby the following parties have committed to a booking engagement and are referred to as Client and SoundONE.

Conditions:

Any booking WHETHER CONFIRMED VERBALLY, ELECTRONICALLY OR IN WRITING will be subject to a legally binding contract carrying the following non-negotiable terms and conditions of booking.

The client hereby engages SoundONE to provide a Mobile Disco Service at a specified location as agreed in the entertainment booking contract.

SoundONE hereby agrees to provide a Disco Service for the Client at the specified location as agreed in the entertainment booking contract.

SoundONE shall consist primarily of providing musical entertainment by means of a recorded format.

By Request, SoundONE hereby agress to render their professional services and is at all times to have complete control of their programme.

The Parties hereby agree that SoundONE shall be provided and accepted on the date(s) and time(s) of the engagement as agreed in the entertainment booking contract.

If SoundONE is requested and/or forced to extend the time limit of their appearance/performance an additional fee WILL be added which is, as agreed in the entertainment booking contract, per hour or part of, payable before the extended time begins.

If early setup is required, (more than 60 minutes before SoundONE should perform) then an early setup fee is charged as agreed in the entertainment booking contract.

Payment Terms:

The Client shall pay SoundONE the amount outlined as "SoundONE Mobile Disco Service Fee" in exchange for said number of hours of service.

A non refundable deposit in the amount outlined as "Deposit" must be paid to SoundONE before any any date/time is secured. If payment is made by cheque, please make payable to A Tugby. *(The deposit is only refunded if SoundONE cancels, explained below.)

The remaining balance must be paid, as agreed in the entertainment booking contract, by BACS or cheque no later than 14 days before the event. Or payment in cash only under special pre-arranged circumstances immediately upon SoundONE's arrival at the event and before SoundONE performs.

Terms:

The Client will be responsible for any damage, normal wear and tear excluded, to equipment (sound/lighting/music equipment and/or damaged to vehicles) caused by anyone in attendance at the event during the contracted time period, including the time allowed for setting up and packing away, unless damage is due to SoundONE's negligence. The full cost of any repairs required will be charged to the booking party representative who will be advised of any damage as soon as it is possible. They will also be responsible for the safe return of any hired equipment from SoundONE.

SoundONE does not tolerate any violent, aggressive or abusive behaviour. We reserve the right to terminate our services at any time should we feel our personal safety or the safety of our equipment is under threat. If this occurs, no refund of any fees will be given and we reserve the right to claim damages against any person(s) concerned.

If a booking has been confirmed and SoundONE attends the function to find another service provider has been booked by you, the promoter(s) or any other persons then the full fee shall be payable as per the agreement.

SoundONE will ensure that they hold valid Public Liability Insurance which may be required by the venue. SoundONE is not responsible for any damage caused to the room or building where the services are provided and is not responsible for any power outages.

SoundONE agree to conduct themselves in a proper manner and respond to the reasonable wishes of the booking representative as to the volume of PA equipment, siting of equipment or any other reasonable requests.

The Client shall ensure the venue will allow SoundONE adequate access time for the setting up and taking down of any equipment. If the performance start time is delayed due to the inability of SoundONE to gain access to the performance area, or any other delay beyond SoundONE's reasonable control, no liability will be accepted and no refund will be given.

Public liability insurance cover provided by SoundONE is only for the protection of the public against damage caused to the public by SoundONE personnel or equipment and not by any action of the Client or anyone in attendance, who may cause any such damage to themselves or others which may include, but is not restricted to them being under the influence of alcohol or other substances.

SoundONE reserve the right to not attend any event without having first received a signed Entertainmant Booking Contract, even if a non refundable deposit has been paid.

Under no circumstances will SoundONE begin rendering services until the balance is paid in full.

SoundONE is not responsible for obtaining any licence that may be required to stage the event. The Client shall ensure that any such licences are obtained prior to the event.

SoundONE at their discretion, reserves the right to discontinue all or part of equipment usage if the power provided is not capable of operating the equipment without risk of damage to the equipment or the public, or if the working environment constitutes a health and safety risk. (If applicable.)

The Client agrees to furnish a facility that completely covers SoundONE's equipment from direct sunlight and or rain. If service must be discontinued for any of the aforementioned reasons, no refunds will be awarded.

If, for whatever reason, SoundONE cannot attend your function, a suitable replacement will be sourced, by SoundONE.

SoundONE shall not be responsible in the case of mechanical failure, resulting in non fulfilment of any of the services they provide.

SoundONE cannot be held responsible for any cleaning costs, however incurred, whilst using any of our products.

Free consultations are offered for all events, however, if travelling is required outside of the Camborne area, SoundONE will charge to cover time and travel expenses.

SoundONE reserve the right to take photographs or video before and during any event for promotional purposes such as for use on our website, all copyright is held by SoundONE and we may use pictures showing people's faces. If you do not wish to have photos published then you must inform us in writing at least 7 days before the event.

If SoundONE has to deliver or set up equipment or products prior to your event this may incur a small charge, the Client is solely responsible for the security of all equipment and products during this time.

SoundONE operates a complaints procedure, complaints should be in writing only and addressed to Mr A. Tugby, 24. Sea View Terrace, Camborne, Cornwall, TR14 7AL.

Errors and Omissions Excluded.

The Parties hereto promise to abide by the terms of this agreement and intend to be legally bound thereby.

Cancellations:

A cancellation will not be accepted within twenty eight (28) days prior to the date of the event. If the event is cancelled within this window of time the Client is responsible to pay SoundONE the balance due.

Once SoundONE arrives at the venue, and/or is paid the remaining balance due, then by the terms agreed upon in this contract, SoundONE will perform services at the event. SoundONE will not be held responsible for the inability to perform for the following reasons:

  • Police or Government Official closing down the event
  • Venue location or promoter not licensed
  • Facility improperly equipped (ie: no electricity)
  • Fire, War, or Act of God

*If SoundONE must cancel for any other reason than those mentioned above, then SoundONE shall refund 100% of the deposit and fees paid.

No guarantee is made by SoundONE of time of arrival; however, SoundONE requests that they be permitted 60 minutes before the engagement and 60 minutes after the engagement for setup and takedown.
